In 1969, Day filed an application with the Department of Health, Education & Welfare (HEW) for determination of a disability and for disability insurance benefits under 42 U.S.C. §§ 416, 423. After a hearing, Days application was denied by a Hearing Examiner. The HEW Appeals Council affirmed the examiners decision, and the decision thereby became administratively final. Day then instituted suit in the District Court. After reviewing the administrative record, the court concluded, without discussion, that the examiners decision was supported by substantial evidence. Summary judgment was thereupon entered against Day. For the reasons stated below, we reverse the District Courts judgment and remand the cause to the Secretary for a new hearing. 42 U.S.C. § 405(g).
